Wheel Wize Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) are a legal agreement between you and Salforge (“we,” “us,” or “our”) governing your use of the Wheel Wize mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

2. Description of the App

The App provides two main features:

• Educational content: lesson decks and quizzes covering general driver education topics for the United States and Canada.
• Driving assistant: an optional tool that uses your device’s motion sensors to give periodic audio or vibration prompts during a drive, for example a reminder to check mirrors.

The App is a study and awareness aid. It is not a certified driver safety device, not a substitute for professional driving instruction, and not a substitute for your own attention and judgment while driving.

3. Eligibility and Use by Minors

The App is intended for a mixed audience, including learner drivers who may be under the age of 13, as many users are studying for a learner’s permit or driver’s license. We encourage parents and guardians of younger users to be involved in and aware of their child’s use of the App. If you are under the age required by your state, province, or country to agree to these Terms on your own, a parent or legal guardian must agree to these Terms on your behalf, and by permitting your child to use the App, you, the parent or guardian, accept these Terms.

4. Educational Content Disclaimer

Content in the App is provided for general driver education and awareness. It is not official state, provincial, or territorial motor vehicle department material, and it is not legal advice. Traffic laws, permit and licensing requirements, and testing procedures vary by state, province, and territory, and they change over time. You are responsible for confirming current, official requirements with your local motor vehicle authority before relying on anything in the App for an actual test, permit, or license application. We do not guarantee that using the App will help you pass any test or obtain any license.

5. Driving Assistant: Important Safety Disclaimer

The driving assistant feature is a supplementary study and awareness aid only. It is not a collision-avoidance system, not a certified safety device, and not a substitute for attentive, responsible driving.

You must never interact with the App, or any phone, while operating a vehicle, except through hands-free audio prompts, and only where this is legal in your jurisdiction and safe to do so. You are solely responsible for operating your vehicle safely and in compliance with all applicable laws at all times, regardless of anything the App does or does not detect, prompt, or alert. Motion-sensor detection is approximate and may be delayed, inaccurate, or fail to trigger. We disclaim all liability for any accident, injury, traffic violation, or other harm arising from your use of, or reliance on, the driving assistant feature. If any use of the App conflicts with your full attention to driving, stop using the App and focus on driving.

6. Advertising and Unlocks

Some App content is unlocked by watching a rewarded video advertisement, as described in our Privacy Policy. Ads are provided by Google AdMob, and their availability, content, and completion requirements are outside of our control and may change without notice. The App currently has no in-app purchases; this may change in the future, in which case these Terms will be updated.

7. Feedback

If you submit feedback through the App, you grant us a worldwide, royalty-free, perpetual license to use it to improve the App, without any obligation to compensate you or attribute it to you.

8. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the App except as permitted by law.
• Interfere with or disrupt the App’s operation, including its advertising or analytics systems.
• Use the App for any unlawful purpose.

9. Intellectual Property

The App, including its content, design, trademarks, and underlying code, is owned by Salforge or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your own device for personal, non-commercial use, subject to these Terms.

10. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that its educational content is complete, current, or error-free for your specific jurisdiction.

11. Limitation of Liability

To the fullest extent permitted by law, Salforge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of, or inability to use, the App, including any traffic violation, accident, injury, or loss related to your use of the driving assistant feature or reliance on educational content. Our total liability for any claim arising from these Terms or the App will not exceed the amount you paid us to use the App in the twelve months before the claim arose, which, for most users, will be zero.

Some jurisdictions do not allow certain limitations of liability, so some of the limitations above may not apply to you.

12. Indemnification

You agree to indemnify and hold Salforge harmless from any claim, loss, or damage, including reasonable legal fees, arising from your use of the App or your violation of these Terms, except to the extent caused by our own gross negligence or willful misconduct.

13. Termination

We may suspend or terminate your access to the App at any time, for any reason, including if we believe you have violated these Terms. You may stop using the App at any time by uninstalling it.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App will be resolved in the courts located in Ontario, Canada, and you consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the Effective Date above. Continued use of the App after a change takes effect means you accept the updated Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
